Education & Disability
Education Law is the area in which we are most recognised as being specialists in. These mainly concern Special Educational Needs (SEN), Disability Discrimination (DDA) but also include other types of cases as well (e.g. Admissions, Exclusions, Transport, etc.)
Douglas has successfully represented many hundreds of clients in Education cases during the past 10 years including:
- Judicial Reviews against Local Education Authorities (LEAs), Schools, Independent Appeal Panels (IAPs) and other Public Bodies;
- Appeals to the Special Educational Needs and Disability Tribunal (SENDIST);
- High Court Appeals against SENDIST decisions (including to the Court of Appeal);
- IAP hearings regarding Admissions and Exclusions.
Douglas has acted in a number of Disability Discrimination (DDA) claims against both Schools and Post-16 Education providers. He has also progressed a large number of Education Negligence cases (regarding the failure to identify or make adequate provision for Special Educational Needs) and has been involved with challenges to decisions over the closure or re-organisation of schools, the banning of parents from school premises, etc. Please note that we are not currently undertaking Education Negligence cases or other Education cases which do not involve SEN/Disability.
Although we mainly advise and represent Parents, their children and Disabled Students, we also advise and represent Schools and Education/Disability organisations.
