Note in Lieu
WHAT IS A NOTE IN LIEU?
Following a Statutory Assessment, an LEA ("Local Education Authority") may decide not to issue a Statement of SEN ("Statement"). If deciding not to issue a Statement then they will issue a "Note in Lieu" of a Statement and should also explain why they have decided that it is not necessary to issue a Statement.
In the Note in Lieu the LEA will utilise the information that they collected during the Statutory Assessment to explain to the parents why the decision not to issue a Statement has been made. In fact the Note in Lieu often looks similar to a Statement. Furthermore, reports from the professionals that were collected will still be used to provide guidance to the child’s school about the child’s needs and what help should be provided for the child. The advice should only be sent to the school with the parent's consent.
Where a parent is unhappy about the LEA's decision not to issue a Statement then they can appeal to the SEND Tribunal.
